QUILLY M. ZINN -- Last Will & Testament

In the name of God Amen:

I Quilly M. Zinn of the County
of Ritchie and State of West Virginia
in being of Sound mind and
deposing Memory make and pub
lish this my last will and n

Testament.  1st I will and bequeath to my wife Lucy Ann Zinn and My Son Marion B Zinn all my real and personal Estate. The real Estate consisting in the farm upon which I now reside, containing Sixty Six and two thirds acres, and a tract of Thirty two and one third acres joining the Said Sixty and two thirds acres, each Situated on the Middle Fork of Hughes River Ritchie County.  The personal Estate consisting of all my household and kitchen furniture, farming utensils, Horses, Cattle, Sheep, hogs and poultry and all notes and accounts due me provided they pay all my my debts and funeral Expenses, and and they comply with conditions that be hereinafter mentioned.

2nd In Case My wife and Son Marion B. Zinn desire to divide the estate I will and bequeath my wife one third of both real and personal Estate, So long as She lives or remains my widow.  The real estate to be So divided that her third will include the house in which I now live, the garden the yard, the Orchard and all the out buildings, and my son Marion B. the other two thirds with conditions that will be hereinafter mentioned.

3rd After the death of My wife or after She ceases to be my widow I will and bequeath all the real and personal estate which She may die or Marry possessed of Shall descend to my son Marion B. Zinn {Zinn is marked out here} provided my Son Shall live with her and provide for her, So as to render her comfortable.   But in case my Son Marion B. Should not do so, I will and bequeath to any other one of my children, that will be hereinafter named the Said on  third

4th I will and bequeath to my other children as follows to wit:   To Mary M. Nutter Twenty five dollars to be paid on demand after the first day of March 1869.  To Cortez L Twenty five dollars. ($25 00/100)  Victory, Twenty {this is marked out} Trist Newton, Wesley W, Palestine, Noah, Columbia A, Martha D, Ulysses S, Grant, Fifty dollars each to be paid on demand after they become of Age by my son Marion B.  But in Case my son Marion B. does not, or does in part comply with the fore-going and wishes not to comply with my desire further, I will and bequeath to any other one of my children that will pay to him one hundred dollars. ($100 00/100) and refund to him what he has paid to those who have demanded and have received the Said two thirds.  In witness whereof I have hereunto Signed my name and affixed my seal this 20th day of March 1868.

Codicil
 

I Quilly M. Zinn make and publish this as a Codicil to my last will and testament to wit: I desire that my son Marion B Shall act as My executor in my last will and Testament and that he perform the duties as Such without giving bond for the performances of Said office.

The Last will and Testament of Q.M. Zinn was this day produced before me in my office and there being no objection to the probate of said will Thereupon  William B. Zinn and Ezekiel Kelly the Subscribing witnesses thereto duly appeared before me in my office and being sworn fully proved Said will Thereupon Said will is fully admitted to record

Of Ritchie County in the State aforesaid do certify that the fore going is a true copy of The Last will of and Testament of Q.M. Zinn,  together with the codicil, and certificate of Proof __  __ {unsure…looks like v c} thereto annexed  and I further certify that Said will had on it when admitted to probate one dollars worth of Internal Revenue Stamps Cancelled.  Given under my hand this 19th  day of August 1868
